Terms & Conditions

Momentset is an online platform that helps participants and attendees discover and purchase photographs from events. Photographers and organizers upload event photos, and users search them using a selfie (face matching) or a bib/ID number. By accessing or using Momentset you agree to these Terms & Conditions.

• You must provide accurate account information and keep it up to date.
• One account per person. Do not share, sell or transfer your account.
• You must be old enough to enter into a binding contract in your jurisdiction.
• You may only upload a selfie that is of you, or of a person who has given you permission to search on their behalf.
• You may not attempt to disrupt, reverse-engineer or abuse the service.

• Prices are displayed before checkout and are charged in the currency shown. Taxes may apply depending on your location.
• Photos are licensed digital goods. No refunds are offered once a photo has been downloaded, except in cases of clear processing errors (e.g., corrupted file, wrong photo delivered) — please contact us and we will make it right.
• Each purchase comes with a download link that expires 48 hours after the order. We recommend downloading and backing up your photos immediately.

All photographs on Momentset remain the copyright of Momentset and/or the contributing photographers and event organizers. Purchasing a photo grants you a personal, non-exclusive, non-transferable license to:

• Display the photo on your personal devices and social media accounts.
• Print the photo for personal, non-commercial use.
• Share the photo for personal, non-commercial purposes.

You may not:

• Resell, sublicense or redistribute the photo commercially.
• Use the photo to promote a business, product or service without a separate written license.
• Remove watermarks from preview images or circumvent any technical protection.

The following section applies to photographers and event organizers who upload content to Momentset.

• By uploading photos you confirm that you own or have all necessary rights to the content, including consents from identifiable subjects where required by local law.
• You grant Momentset a worldwide license to host, process (including via AWS Rekognition and Textract), display previews, watermark, transcode, and sell the photos through the platform.
• Revenue share, pricing tiers and exclusivity terms are agreed separately on a per-photographer or per-event basis in writing.
• You agree not to upload content that is unlawful, defamatory, infringing, or that depicts minors in a way that violates applicable child-safety or privacy laws.
• Momentset may remove content at its discretion to comply with the law, respect a valid takedown request, or enforce these terms.

Momentset is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

We are not liable for indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill. Our total aggregate liability arising out of or relating to the service will not exceed the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, or (b) USD 100.

You may close your account at any time by emailing hi@momentset.app. We may suspend or terminate accounts that violate these terms, abuse the service, or pose a risk to other users or third parties.

On termination, your right to use the service ends immediately. Photos you have already purchased remain licensed to you under the terms above, but you will lose access to any download links that have expired.

These Terms are governed by the laws of the State of Kuwait, without regard to its conflict of laws principles. The courts located in Kuwait City will have exclusive jurisdiction over any dispute arising out of or in connection with these Terms, except where mandatory consumer-protection laws of your country of residence provide otherwise.

We may update these Terms from time to time. Material changes will be communicated by email or via the service. Continued use of Momentset after the changes take effect constitutes acceptance of the updated Terms.
